Lawsuit filed over Yellowstone River oil spill

A class action lawsuit was recently filed against ExxonMobil over the 42,000 gallon oil spill in the Yellowstone River.

The lawsuit was filed in Yellowstone County District Court by eight landowners who claim that the oil spill caused damage to them and their property through nuisance and trespass, according to the Billings Gazette.

In addition, the lawsuit alleges ExxonMobil has failed to use proper oil spill cleanup methods, leaving the plaintiffs’ properties in a state of dissarray.

Brad Kembel, one of the plaintiffs, said that there have been a number of cleanup teams who have come to his property but they have been largely ineffective. The third one, he contends, rode ATVs all over his property and repeatedly missed the same pool of oil.

“They had ridden by a patch of oil so many times, their dust covered it up,” Kembel told the news source.
