A resident of Morgan City, Louisiana, recently filed a lawsuit against Wal-Mart Stores Inc. claiming she slipped and fell on a foreign substance that was left on the floor.
According to the Louisiana Record, Mirta Martinez claims she was shopping at a Wal-Mart store in Houma, Louisiana, last January when she slipped, falling to the ground and sustaining serious injuries including a compression fracture in her neck.
Martinez, who filed the slip and fall lawsuit in federal court in New Orleans on September 8, accuses Wal-Mart employees of negligence for allowing the foreign substance to remain on the floor. She also claims the retail chain did not sufficiently train its employees to utilize the proper warning signs.
The Record reported that Martinez is seeking more than $75,000 in damages related to personal injuries sustained, pain and suffering and medical expenses. In addition to the compression fracture, Martinez allegedly sustained a number of abrasions and bruises as a result of the incident.
According to the Centers for Disease Control and Prevention (CDC), older citizens are particularly susceptible to slip and fall injuries, with one in every three adults age 65 and older experiencing a fall each year.
