A Santa Fe, New Mexico, paving company that faces fines of more than $800,000 for its mishandling of hazardous materials could be headed to court if it fails to settle the matter with state officials.
The Santa Fe New Mexican reports that the state Environment Department may take Advantage Asphalt and Seal Coating to court to get the firm to pay the $817,000 fine. The company is accused of the improper disposal of asbestos at a landfill and dumpster, even after it was warned that the waste required special treatment. Jim Winchester, a spokesman for the department, told the news agency that talks with Advantage Asphalt failed to reach a settlement agreement. A formal discovery process is now underway to determine if the state will file suit against the company in district court.
The company has also been the focus of an investigation by the Santa Fe County Sheriff’s department over allegations of fraud, theft, shoddy work and possible collusion in wrong doing by county employees.
